Classicist.org Terms of Use

Classicist.org is published and maintained by The Institute of Classical Architecture & Art (ICAA), 20 West 44th Street, Suite 310, New York, NY, 10036. The ICAA has regional Chapters (“Chapters”) that may publish and maintain content on websites that are not classicist.org and are not under the control or responsibility of the ICAA. By visiting classicist.org, and/or using the services offered through classicist.org the user agrees to the Terms of Use herein. The ICAA reserves the right to amend the Terms of Use at its discretion and without notification to the user without notification beyond a revision to the terms described herein. Use of classicist.org indicates the users ongoing acceptance of the Terms of Use: 

  1. Classicist.org, including any content and materials thereon, are only for personal, educational, non-commercial use. The user may not use contents and/or materials from classicist.org for commercial purposes without express, written permission from the ICAA.  
  2. Classicist.org, including all content and services, are provided “as is” and “as available.” The ICAA makes no representation or warranties (neither express nor implied) for the website, including content, services, and servers, nor does the ICAA make representations or warranties for the websites of its regional Chapters or affiliates. Under no circumstances shall the ICAA be liable for the use of or inability to use classicist.org, including but not limited to viruses, cyber security, errors in content, outdated content, broken links, and other technical defects.  
  3. All material on classicist.org including but not limited to images, text, software, marks, logos, audio, and video, is owned by the ICAA or is used with permission of or through agreements with ICAA partners, affiliates, or licensors.  
  4. Contents and materials within classicist.org are protected by U.S. copyright laws, international conventions, and copyright laws of New York State.  
  5. The information published on classicist.org or a linked site may include inaccuracies or typographical errors, and ICAA specifically disclaims any liability for such inaccuracies or errors. ICAA does not warrant or represent that the content on the site is complete or up-to-date. ICAA may change the content on the site at any time without notice.  
  6. The user shall refrain from the following unauthorized uses of classicist.org: 

    1. impersonating any person or entity, whether actual or fictitious, or misrepresenting your affiliation with any other person or entity, 
    2. inserting advertising, branding, or other promotional content into any classicist.org content, or using or exploiting any classicist.org content or services for any further commercial or promotional purposes,  
    3. attempting to gain unauthorized access to any other computer systems through classicist.org,  
    4. harvesting any e-mail addresses, physical addresses, or other contact or personal information through "spidering," "screen scraping," "database scraping," or any other automatic means of obtaining information,   
    5. obtaining or attempting to obtain unauthorized access to ICAA computer systems, materials, or information through any means,  
    6. using classicist.org in any manner with the intent to interrupt, damage, disable, overburden, or impair the website or any supported services,  
    7. using classicist.org in violation of the ICAA's intellectual property or other proprietary or legal rights, or,  
    8. using classicist.org in violation of any applicable law. 
  7. The user agrees not to share, upload, post, transmit, distribute, or otherwise publish through classicist.org, any content, including but not limited to text, photos, and audio visual materials which: 

    1. restricts or inhibits any other user from using classicist.org, 
    2. is erroneous, fraudulent, dangerous, unlawful, threatening, abusive, harassing, libelous, defamatory, obscene, vulgar, pornographic, sexually explicit, or indecent,  
    3. is commercial in nature, including advertising or pyramid schemes,  
    4. constitutes or encourages a criminal offense, 
    5. gives rise to civil liability,  
    6. plagiarizes or infringes on the intellectual property rights of third parties, 
    7. infringes on rights of privacy or publicity of third parties. 
  8. The ICAA reserves the right, but does not have an obligation, to monitor and/or review all materials posted to classicist.org. The ICAA is not responsible for any content or materials posted by users.  
  9. The ICAA reserves the right to remove and/or refuse to publish content for any reason. Any content that the user shares, uploads, posts, transmits, distributes, or otherwise publishes through classicist.org may be removed from classicist.org. The ICAA has no obligation to return, save, or preserve user-generated content. 
  10. The user grants the ICAA a non-exclusive, irrevocable, worldwide, royalty-free right and license to exhibit and otherwise use (and to authorize third parties to exhibit and otherwise use) the user-generated content in perpetuity on ICAA’s website(s), blog(s), mobile website(s), mobile app(s), emails, and ICAA-branded digital and social media channels.  
  11. The ICAA reserves the right at all times to disclose any information and user-generated content as necessary to comply with any law, regulation, or government request, with or without notice to the user.  
  12. Classicist.org contains links to other websites. The ICAA is not responsible for content contained within websites that are not classicist.org, including but not limited to the websites of the ICAA’s Chapters. Links, pointers, and mentions do not imply that the ICAA is affiliated or associated with a third party, or that the third party has any affiliation, association, or partnership with the ICAA.   
  13. The user agrees that ICAA, its affiliates and any of their respective officers, directors, employees or agents will not be liable, whether in contract, tort, strict liability or otherwise, for any indirect, punitive, special, consequential, incidental or indirect damages arising out of or in connection with the use of the site or a linked site. This limitation on liability includes, but is not limited to, the transmission of any viruses which may infect a user’s equipment, failure of mechanical or electronic equipment or communication lines, telephone or other interconnect problems. 
  14. The user agrees to indemnify, defend, and hold the ICAA, including its officers, directors, agents, employees, contractors, volunteers, information providers, and affiliates, (collectively, the “Indemnified Parties”) harmless from and against any and all liability, costs, and attorney’s fees incurred by the Indemnified Parties in connection with any claim arising out of his or her use of classicist.org, or any breach by the user of the terms herein.  
  15. The user shall cooperate as reasonably required in the defense of any claim. The ICAA reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by the user. The user shall not in any event settle any matter without the written consent of the ICAA. 
  16. The ICAA may revise, terminate, suspend, or discontinue any aspect of classicist.org at any time. The ICAA may restrict, suspend, or terminate user’s access to classicist.org and its services for any other reason without notice or liability.  
  17. The Terms of Use shall be governed by the laws of the state of New York, without regard to conflicts of law principles. Jurisdiction for any action, claim, or proceeding arising out of or related to use of classicist.org shall be in state or federal court located in New York state. If for any reason a court of competent jurisdiction finds any provision in the Terms of Use to be unenforceable, the remainder of this Terms of Use shall continue in full force and effect.
